MOBILE INTERNET RENTAL CONTRACT – September ’10

Art. 1) Purpose of the contract - The purpose of this contract is to provide for the rental of a wireless high speed modem through a USB modem to get the connection service to the Internet with wireless technology named HDSPA (High Speed Downlink Packet Access) using a Subscriber Identification Module (SIM) to the customer and assure payment of the service, according to the conditions and the terms hereunder described.
Art. 2) Company supplying the service – Student Free Move is a trade mark property of Italy Cell Phones s.a.s. di S.Sposimo – Corso dei Tintori, 29/r – 50122 Florence, Italy.
Art. 3) Carrier providing the service - The Carrier providing the service is “H3G” and there is no way to use different carriers neither in Italy nor in Europe. 
Art. 4) Rental policy- The service can be supplied only to those clients subscribing first for the rental of a cell through “Student Cells” and with a reasonable use of the cell. If no calls are made with the given cell phone, the contract will be terminated, and client will be reimbursed for the full unused months paid in advance, while the setup fee will not be reimbursed. Clients subscribing with other companies must discontinue their old contract to get a cell without any rental charge. Further details on how to do that will be given to the client time by time.
Art. 5) Rates and payment – The rental fee is 49 euro/month wit a one time setup fee of 25 euro. The monthly service fee includes Internet connection with up to 5 Gigabites of weekly traffic. Text messages are not included in the plan. Payment for the full period of usage is due at laptop pickup. Special rates may be offered for summertime usage.
Art. 6) Trial period - Clients has three days to test the modems and its service. If the client is not satisfied he/she will return the modem to the office and he/she will reimbursed for the amount paid excluding the 25€ setup, not refundable. The amount will be credited to the client’s credit card in about 10 days. After this period it will be possible to breach the contract by paying an early return fee, according Art. 16 below.
Art. 7) Obligations of the Customer - The Customer declares that the rented modem is in excellent state of maintenance and is operational, and agrees that he/ she will use it with care and return it in the same excellent state of operation and maintenance, with the original packaging and accessories. The Customer will also be responsible for any other cost or charge due to an improper or unauthorized use of the appliances and the service. Also the Customer is obliged neither to remove the security seal, open, remove or tamper the connection device nor to change the original setting of the software, and he/she will be liable for any cost or extra fee arising with this forbidden operations. 
Art. 8) Rental period and return of modem- The rental period is per month. Period shorter than one month will be billed for a full month and no discounts are negotiable neither for the rental period nor for the setup fee. The modem must be returned at the end of the term unless special arrangements were made ahead of time to extend service by emailing to info@studentfreemove.com 
All modems will be returned to: 
a) Florence Students: Student Free Move - Italy Cell Phones - Corso dei Tintori , 29 red number - Florence
b) Rome, Syracuse, Milan and Siena Students: Directly to their Program Coordinator. In the case of the Customer needing to use the modem for a period longer than the duration of the academic course, the Customer must make this request to Student Free Move at least 30 days in advance of the normal return date; otherwise extended use of the connection device will not be possible. 
Art.9) Misuse, loss, theft, unreturned - In the case of misuse, loss or theft of the modem or the modem is not returned:
a) The customer must report (loss or theft) immediately to the telephone number 848-STOLEN, (this must be done in order to disable the use of the MODEM illegally by third parties);
b) The Customer will be charged for the replacement of the modem (euro 100.00) according the official price list;
c) The Customer will be responsible for the payment of all eventual internet connections by third parties, which occurred due to theft or loss of the MODEM from the time the connection device is lost or stolen until the time the rental agent is notified.
d) In the case the modem is lost, stolen, crashed or is dropped in a liquid (water, beer, tanning oil, etc) the Customer agrees to pay the cost for a brand new modem (100,00 euro) according the official price list posted in the website www.stuentcells.com. 
e) The Customer declares that the rented modem is excellent state of maintenance and is operational, and agrees that he/she will use it with care and return it in the same excellent state of operation and maintenance, with the original packaging and accessories. Missed parts (packaging, modem cap, sim card door , extra extension wire) will be billed separately at the rate of 40 euro each to a maximum of 100 euro
Art. 10) Text messaging- Even if it’s possible text messaging by using the given MODEM, text messages are not included in the plan and thus billed separately.
Art.11) Limits of usage. - The plan includes 5 G Byte of usage per week (download and upload capacity). This amount of traffic is rarely reached unless using a peer-to-peer program or file sharing programs. Should the client overcome this limit, the traffic in excess will be billed at the rate of 25 €/ Gbyte or fraction of it. 
Art. 12) Control of Internet usage- A tracking system will warn students, both by txt message and email, when they are getting the 80% and the 95% of their weekly traffic. This messaging system is available during weekend, so it’s student responsibility to have a correct use of the internet.
Art. 13) Security deposit. - The Customer is not asked to pay a security deposit; however, he/she will be required to leave a copy of his/her credit card. The client agrees that Italy Cell Phones is allowed to use said credit card for paying fee lost/stolen modem fee or for paying extra allowance traffic. 
Art. 14) Extra charges.- Charges for extra allowance traffic and  for text messaging are reported by Carrier. The records contain the used quantity of data, without the visited websites, and extra charge will apply according these records.
Art. 15) Billing – The Customer must pay the fee for the full duration of the rental period and the setup fee in one lump at the beginning of the service.   
Art. 16) Early return – After the trial period, if the Client returns the rented item earlier than the period reserved Student Free Move has the right to charge the Client 25,00 euro for every month of anticipated usage contingent on the contract dates (based on the calendar month without fractions). The 25 € onetime setup fee is not reimbursable.
Art. 17) Additional debits and legal charges - Charges to the given credit card may be debited within a 120 day after the end of the contract. Outstanding balances due exceeding 45 days will be referred to Student Free Move. Collection Service  - NCCS, 3700 Montgomery Dr., Santa Rosa, CA  95405 USA, or Student Free Move attorneys. *Withheld transcripts for outstanding balances on cell phone accounts will not be released until accounts are paid in full. 
Art. 18) Transcripts - Academic transcripts will be held until the customer dissolves all debt to Student Free Move for modem service. 
Art. 19) Responsibilities - The Customer, agrees to indemnify, hold harmless, and otherwise be responsible to the company, Italy Cell Phones, for any damage, claim or consequence that arises or could arise from the improper and illicit use of the modem.  
Art. 20) Privacy- The Customer is aware that according the Italian Law on communication to prevent both int’l terrorism and pedophilia all the Internet traffic is tracked and the Carrier providing the service safely stores the electronic log. The Carrier provides to identify each customer through the SIM card used at the beginning of each internet session. The content of the log is confidential and can be exhibited only upon the request of the Postal Police or the competent Court of Law. 
Art. 21) Supplying the connection – Since the connection may be not available in some areas or due to technical problems (thickness of walls, weakness of service, etc), the Student Free Move can refuse to supply the service and will not be liable for any damage, losses or costs incurred by customer as a result of do not supplying the service. 
The carrier may be temporarily interrupt, delay or limit the wireless service for a variety of reasons including, but not limited to, availability of radiofrequency channels, system capacity limitation and transmission limitation due to atmospheric or other conditions, equipment modification and/or repairs. Italy Cell Phones do not guarantee the Client uninterrupted service. Due to these external conditions, the Client will not reimbursed for the interrupted service. No refund will be issued for the traffic failed to made and this includes dropped connections and connection speed below the one advertised by the carrier and thus by Student Free Move.
Art. 22) Competent Court - For any conflicts or disputes that may arise under this contract, the Court of Florence, Italy is deemed to be the exclusive competent Court of Law, and for everything not expressly previewed in this contract, the pertinent law as enforced in Italy will apply.

The client agrees with the present contract in all its parts, especially with art: 4,5,8,9,10,11,12,13,14,15,16,1718,19,21,22
